Daniel’s areas of practice include advising businesses and individuals on transactions, contracts and employment issues and litigating their commercial, business, construction, insurance and ADA lawsuits. He also defends employers in discrimination/harassment and Fair Labor Standards Act claims. In addition, Daniel handles personal injury claimsfor plaintiffs and defendants and a wide variety of real estatedisputes and lawsuits.
A Philadelphia native, Daniel graduated from Muhlenberg College with a Bachelor of Arts in political science in 1978. After receiving his Juris Doctor from Harvard Law School in 1981, Daniel moved to Miami to practice First Amendment law, commercial litigation, workers’ compensation defense and construction litigation with several prominent law firms. In 1984, Daniel relocated to West Palm Beach, where he joined the law firm now known as Ciklin Lubitz. He spent the next seven years working as a litigator and trial lawyer, handling a broad spectrum of matters, including insured fire and casualty losses, title insurance defense, libel claims, business interference suits and commercial collections.
In 1991, Daniel joined the litigation team of W. R. Grace & Co., an international conglomerate, at its world headquarters in Boca Raton. At Grace, Daniel defended the company in scores of multi-million dollar lawsuits attacking the safety and integrity of its asbestos-containingfire-proofing products. In 2001, Daniel was recruited to oversee all litigation for RailAmerica, Inc., a railroad holding and operating company with several thousand employees and 50 different operations in 26 states, five Canadian provinces, Chile and Australia. When RailAmerica left South Florida in 2008, Daniel joined G4S Secure Solutions USA to oversee its litigation, including employment discrimination and harassment claims. As the head of litigation at two companies for 10 years, Daniel resolved hundreds of cases, ranging from federal agency claims to toxic tort mass disasters to a tunnel collapse. He has investigated company and employee misconduct and negotiated commercial contracts and lawsuit settlements throughout North America. While in-house, Daniel regularly wrote legal pleadings and contracts and tried cases before judges and other hearing officers.
After 10 years of private practice, followed by 19 years as a client and an in-house lawyer, Daniel resumed the private practice of law in the spring of 2011. In 2012, Daniel attained AV Preeminent status from LexisNexis Martindale-Hubbell, giving him the highest possible rating in both legal ability and ethical standards.
